Romero v. City of Lansing is important because a two-judge majority of the Sixth Circuit held that, taking the facts in the light most favorable to the plaintiff, a man who had been involved in a heated domestic, who was armed, and who twice reached toward his holstered handgun could still be viewed as complying with officers when they fired the second volley of shots.
